Terms & Conditions for DualRec

Welcome to DualRec. Please read these Terms & Conditions ("Terms") carefully before downloading, installing, or using the DualRec mobile application ("Service") operated by DualRec ("we", "us", or "our").

By downloading or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not install or use the application.

1. License Grant

Subject to these Terms, DualRec grants you a personal, non-exclusive, non-transferable, revocable license to download, install, and run the application on compatible Apple iOS devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

This license permits use for both personal and commercial media production (including, but not limited to, content creation for YouTube, TikTok, Instagram, client video production, and commercial media distribution).

2. User Content & Full Ownership

  • You retain 100% ownership of all videos, audio recordings, script text, and creative media produced using DualRec.
  • DualRec claims no intellectual property rights, licenses, royalties, or ownership claims over any content you record, edit, or export through the Service.
  • Because DualRec has no cloud backend, you are solely responsible for backing up your recorded media to iCloud or external storage.

3. Acceptable Use & Recording Consents

You agree to use DualRec in full compliance with all applicable local, national, and international laws, regulations, and privacy statutes. You acknowledge and agree that:

  • You are solely responsible for obtaining any necessary consents, releases, and permissions from any individuals being recorded (including audio and video recording laws in your jurisdiction).
  • You will not use the Service for any unlawful, harassing, defamatory, or invasive surveillance activities.

4. AI Assistive Features & Disclaimer of Warranty

DualRec is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, statutory, or implied, to the maximum extent permitted by applicable law.

  • AI Assistive Features: Features including Smart Frame (automated subject tracking and cropping) and the Voice-Follow Teleprompter rely on device hardware sensors and on-device machine learning models. Performance and accuracy may vary depending on ambient lighting, acoustic noise, device temperature, and processing capabilities. These tools are provided as assistive conveniences without guarantees of perfect framing or transcription accuracy.
  • Hardware & Recording Performance: While DualRec is heavily optimized, we cannot guarantee uninterrupted capture sessions, absence of frame drops, or zero hardware thermal throttling under prolonged heavy capture conditions.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall DualRec, its developers, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages—including, without limitation:

  • Loss of video recordings, corrupt media files, or data loss;
  • Device hardware damage or battery degradation;
  • Interruption of business, freelance production, or client delivery timelines.

6. Apple Platform Terms

These Terms supplement, and do not replace, Apple's Licensed Application End User License Agreement and the Apple Media Services Terms and Conditions. You acknowledge and agree that:

  • These Terms are entered into between you and DualRec only, not with Apple Inc. ("Apple"). DualRec, not Apple, is solely responsible for the application and its content.
  • Apple has no obligation whatsoever to furnish any maintenance or support services with respect to DualRec.
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
  • DualRec, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
  • In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, DualRec, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.
  • You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Maharashtra, India, without regard to its conflict of law principles.
